PRAYER : Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents 1 to 6 to take necessary action to recover the amount and jewels from the seventh respondent and to register FIR against the seventh respondent based on the petitioner's complaint given on 20.02.2026 and consider the petitioner's further
representation dated 11.03.2026.

ORDER
This petition has been filed seeking for a direction to the respondents 1 to
6 to take necessary action to recover the amount and jewels from the seventh respondent and to register FIR against the seventh respondent based on the petitioner's complaint given on 20.02.2026 and consider the petitioner's further
representation dated 11.03.2026.
2. The learned counsel appearing for the petitioner submitted that the
petitioner had lodged a complaint against the 7th respondent alleging misappropriation and theft, whereby the petitioner was defrauded to the extent of Rs.6.5 lakhs and six sovereigns of gold jewellery. It is further submitted that

though a complaint was given against the 7th respondent, no action has been
taken thereon
3. The learned Government Advocate appearing for the respondent
police submitted that the 7th respondent is none other than the husband of the petitioner’s sister, and that an enquiry was conducted, during which the 7th respondent gave an undertaking before the respondent police that he would
return the money and jewellery to the petitioner within 15 days.
4. In reply, the learned counsel appearing for the petitioner submitted
that the 7th respondent has not yet returned the money and jewellery in terms of
his undertaking.
5. Heard the learned counsel on either side and carefully perused the
materials placed before this Court. Since no adverse order is proposed to be
passed against the private respondent, notice to him is dispensed with.
6. Since it is seen that an enquiry was earlier conducted and the 7th
respondent had given a written undertaking that he would return the money and jewelry within 15 days, and the same has not been duly complied with, the 5th

respondent police is directed to reopen the case, issue notice to the petitioner and the 7th respondent under Section 64 of the BNSS, and conclude the enquiry within a period of three weeks from the date of receipt of a copy of this order. If the 7th respondent fails to return the money and jewelry, the 5th respondent
police is directed to take appropriate action in accordance with law.
7. With the above direction, this writ petition stands disposed of.
