Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of MANDAMUS to direct the 3rd respondent to appoint the petitioner to the post of Special Teacher (Locomotor Impairment and Cerebral Palchy) by disposing the petitioner's representation dated 02.03.2026 within the time limit that may be stipulated by this Court.

ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the 3rd respondent to appoint the petitioner to the post of Special Teacher (Locomotor Impairment and Cerebral Palchy) by disposing the petitioner's representation dated 02.03.2026 within the time limit that may be stipulated by this Court.

2.This Court is of the considered opinion that the positive direction to appoint the petitioner cannot be granted. Therefore, that portion of the prayer is rejected.

3.As far as considering the petitioner's representation is concerned, the petitioner is seeking to amend the adhoc rules issued in GO.Ms.No.144, School Education (SE3(2)) Department, dated 17.06.2025. The petitioner is specifically seeking to include the qualification of B.Ed., (Locomotor Impairment and Cerebral Palchy) in the said rules. However, it is seen that in the rules PG diploma and Special Education Locomotor Impairment and Cerebral Palchy is included but B.Ed., is not included. The respondents have consciously left B.Ed. Moreover, it is a policy decision of the Government. Therefore, any positive direction cannot be granted to include the said B.Ed., degree.

4.The first respondent is directed to consider the petitioner's representation dated 02.03.2026 for including the qualification of B.Ed., in the Adhoc rules and the same shall be considered in accordance to law within a period of three months from the date of receipt of a copy of this order.

5.With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
