IN THE HIGH COURT OF JUDICATURE AT MADRAS
G. R. Swaminathan, V. Lakshminarayanan, JJ
K. Bhuvaneswari – Appellant
Versus
Union Of India – Respondent
WP No. 20577 of 2026 | WMP No.22120 of 2026
For the Appellants/Petitioners: Stalin Abhimanyu
For the Respondents: Vasantha Kumar
The court held that a community certificate can be issued to children based on the mother's origin, provided the authorities incorporate a suitable rider regarding the certificate's validity.
Headnote:The petitioner filed a writ petition under Art. 226 of the Constitution of India seeking a mandamus to compel the issuance of community certificates for her children based on the mother's origin in the Union Territory of Puducherry. The petitioner contended that her children were entitled to such certificates despite the father's origin. The court addressed the issue of whether a community certificate can be issued to children based on the mother's community status. The court determined that authorities are obligated to issue the certificate, provided it includes a standard rider, and clarified that incorporating such a rider does not invalidate the certificate for legal purposes. The writ petition was disposed of with a direction to the respondents to issue the certificate as requested.
