IN THE HIGH COURT OF JUDICATURE AT MADRAS
Mummineni Sudheer Kumar, J
R. Kumaresa Pandian – Appellant
Versus
Chief Educational Officer – Respondent
W.M.P.(MD) No.6658 of 2026
For the Appellants/Petitioners: G. Karthik
For the Respondents: N. Satheesh Kumar
A Writ of Mandamus for salary disbursement becomes infructuous when the authorities comply with the payment obligation upon the petitioner's submission of requisite administrative documentation, leaving other pending arrears to be addressed through existing judicial directions.
Headnote:The petitioner sought a writ of mandamus for the disbursement of salary and attendant benefits pending since 08.12.2025. The court examined the grievance regarding non-payment due to pending administrative documentation, specifically IT forms, and directed the petitioner to submit the necessary records. The court verified that subsequent to the submissions, the salary payments were initiated. The primary issue involved the failure of the respondents to release salary and benefits despite previous appellate court directions in similar matters. The ratio decidendi rests on the established compliance by the authority to disburse salary upon the petitioner's submission of requisite forms and the Court's observation that disputes regarding arrears prior to the identified date fall under existing judicial mandates, precluding the need for fresh adjudication. The Writ Petition is closed, with liberty granted to the petitioner to pursue alternate remedies for any residual claims.

This Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the first and second respondents to disburse salary and all other attendant benefits in the light of the proceedings dated 08.12.2025 on the file of the second respondent, issued pursuant to the orders passed by this Court in W.A. (MD) Nos.710 and 711 of 2025 dated 13.06.2025, by considering the petitioner’s representation dated
09.02.2026.
2. The grievance of the petitioner in the present Writ Petition is with regard to the non-payment of salary for the period during which he has worked in the third respondent school from 08.12.2025. This Court, taking note of the same, directed the learned Additional Government Pleader appearing for the first and second respondents to get instructions.
3. Accordingly, on 11.03.2026, the learned Additional Government Pleader, on instructions, submitted that for want of submission of IT forms, the respondents were unable to disburse the salary to the petitioner with effect from 08.12.2025. By an order dated 11.03.2026, this Court permitted the petitioner to submit the IT forms before the second respondent through the third respondent.
4. Today, the petitioner is stated to have submitted the necessary forms. According to the learned Additional Government Pleader appearing for the first and second respondents, the salary payable to the petitioner with effect from 08.12.2025 has been disbursed and will continue to be paid so long as the petitioner continues to work.
5. Insofar as the grievance of the petitioner relating to payment of salary prior to 08.12.2025 is concerned, an order has already been passed by the Hon’ble Division Bench of this Court on 13.06.2025 in W.A. (MD) Nos.710 and 711 of 2025, directing the third respondent school to disburse the arrears of salary and all other attendant benefits within a period of eight weeks. In view of the same, the petitioner has to work out his remedies pursuant to the said order and the same need not be re-
adjudicated in the present Writ Petition.
6. In the light of the fact that the petitioner’s salary is being paid from 08.12.2025, this Writ Petition is closed, granting liberty to the petitioner to pursue the remedies otherwise available, including for differential salary, if any, after 08.12.2025. No costs.
