This Writ Petition has been filed under Article 226 of the Constitution of India praying for issuance of a writ of certiorarified mandamus to call for the records pertaining to the order dated 25.11.2022 made in Na.Ka.No.1280/2022/A2 of the 2nd Respondent and to quash the same and directing the 2nd Respondent herein to strike off the Petitioner’s lands from acquisition or in the alternative pay compensation for the Petitioner’s lands viz., vacant triangular type house site Plot measuring an extent of 00140 Square Meter or 1506 Square Feet comprised in Grama Natham Old Survey No.835/B-2 Part, Grama Natham New Survey No.1226/32, situate in No.68, Athur Village, Chengalpattu Taluk and District from acquisition or in the alternative accord proper and due compensation as per the guideline value

prevailing in that area to the Petitioner.

ORDER

The relief sought in this Writ Petition is to call for the records pertaining

to the Order dated 25.11.2022 bearing Na.Ka.No.1280/2022/A2 passed by the 2nd Respondent and to quash the same and to direct the 2nd Respondent to strike off the Petitioner’s land viz., vacant triangular type house site Plot measuring an extent of 00140 Square Meter or 1506 Square Feet comprised in Grama Natham Old Survey No.835/B-2 Part, Grama Natham New Survey No.1226/32, situated at No.68, Athur Village, Chengalpattu Taluk and District from acquisition or in the alternative, pay compensation for the Petitioner’s acquired land as per the

guideline value prevailing in that area, to the Petitioner.

2. The brief facts of the case are as follows:

During the year 2022, the Petitioner’s land was acquired for Chennai –

Kanyakumari Industrial Road Scheme. Hence, the aggrieved Petitioner submitted a Representation dated 14.06.2022 to the Respondents 1 & 2, requesting that if at all any lands belonging to him are acquired by the Government, the acquisition should be done by due process of law by issuing necessary notice to him and after conducting proper enquiry and if his land is acquired, proper compensation may be given to him as per the guideline value prevailing in the area where his land is situated. However, there was no response for the said representation. Hence, the Petitioner sent another Representation to the 4th Respondent making the very same request, but, there

was no reply to the said representation too.

3. Since there was no reply from the Respondents for the aforesaid

representations, Petitioner filed a writ petition in W.P.No.17356 of 2022 before this Court praying to direct the Respondents herein to issue necessary notice and conduct proper enquiry by due process of law before acquiring his land by considering his Representations dated 22.04.2022 & 14.06.2022. This Court vide Order dated 08.07.2022, disposed of the said W.P.No.17356 of 2022 by

observing as follows:
