PRAYER:-

Writ Petition filed under Article 226 of the Constitution of India, praying for an issuance of Writ of Mandamus, directing the 1st respondent to consider the petitioner’s representation dated 6.7.2022 and conduct the enquiry and cancel the sale deed dated 16.04.2015 registered as document No.1070 of 2015 on the file of 2nd respondent within time stipulated by this Court.

ORDER

This writ petition has been filed seeking to direct the 1st respondent to consider the petitioner’s representation dated 6.7.2022 and conduct the enquiry and cancel the sale deed dated 16.04.2015 registered as document No.1070 of 2015 on the file of 2nd respondent.

2.Learned Additional Government Pleader appearing for the respondents 1 and 2 would submit that the petitioner has sought to consider his representation and cancel the sale deed. Since Section 77-A of the Registration Act, 1908 was struck down by the Hon’ble Division Bench of this Court, the prayer sought for in the present writ petition cannot be entertained. Hence, he prayed to pass appropriate orders.

3.As rightly contended by the learned Additional Government Pleader appearing for the respondents 1 and 2, the official respondents have no power to cancel the sale deed as requested by the petitioner in his representation dated 06.07.2022, since Section 77-A of the Registration Act, 1908, was struck down.

Hence, no mandamus can be issued as requested by the petitioner.

4.In view of the above, this writ petition stands dismissed. No costs.
