PRAYER:-Writ Petition filed under Article 226 of the Constitution of India, praying for an issuance of Writ of Mandamus, directing the respondents to segregate and preserve the CDR particulars and other connected data of the mobile phone numbers 8754390931 and 9095504484 for the period between 1.02.2022 and 28.02.2023 in compliance with the law declared in Para Nos. 63 and 64 of the judgment reported in 2020 (7) SCC1 by considering the

petitioners representation dated 12.11.2023.

ORDER

This writ petition has been filed seeking to direct the respondents to

segregate and preserve the CDR particulars and other connected data of the mobile phone numbers 8754390931 and 9095504484 for the period between 1.02.2022 and 28.02.2023 in compliance with the law declared in Para Nos. 63 and 64 of the judgment reported in 2020 (7) SCC1 by considering the

petitioner’s representation dated 12.11.2023.

2.Learned counsel for the petitioner would submit that the petitioner

made a representation dated 12.11.2023 before the respondents requesting to preserve the comprehensive call detail record (CDR) of the phone numbers of Pravena Jose and her husband Vishnu Ranjan for the period between 01.02.2022

and 28.02.2023. However, the representation of the petitioner has not been

considered till date. Hence, the present writ petition has been filed.

3.Considering the submission made by the learned counsel for the

petitioner and in view of the limited prayer sought for in this Writ Petition, without going into the merits of the case, this Court directs the 2nd respondent to consider the representation of the petitioner dated 12.11.2023 by taking into consideration of the Paragraph Nos. 63, 64 and 73.4 of the judgment reported in 2020 (7) SCC 1, within a period of twelve (12) weeks from the date of receipt of a copy of this order. Till such time, the interim order dated 29.01.2024 passed

in the present writ petition continues.

4.With the aforesaid direction, this writ petition is disposed of. No costs.

Consequently, connected miscellaneous petition is closed.
