ORDER
This Writ Petition has been filed seeking a Writ of Mandamus directing the respondents 1 to 5 to settle the medical reimbursement claim of Rs.6,67,823/- to the petitioner under New Health Insurance Scheme, based on the proceedings of the 3rd respondent dated 06.07.2021 and 2nd respondent dated 27.07.2022, with 12 percent interest for delayed payment.
2. Heard the learned counsel appearing for the petitioner, the learned counsel appearing for the respondents 1 to 4 and the learned counsel appearing for the fifth respondent.
3. The petitioner herein who is a retired Teacher and a pensioner is covered by the Tamil Nadu Government Pension Scheme operated by the fifth respondent. The petitioner was infected with covid-19 virus and was admitted in Sudharson Platinum Hospital from 25.05.2021 to 06.06.2021. The petitioner claims to have incurred expenditure of Rs.6,67,823/-. The petitioner being beneficiary of the New Health Insurance Scheme, made a claim for reimbursement of the said amount incurred by him for his treatment and the same was forwarded by the third respondent to the second respondent, who in turn proposed the reimbursement of the said amount to the petitioner through proceedings in Rc.No.15435/NHIS-3/2022, dated 27.07.2022 along with several other claimants. The proposal has not yet been considered by the fifth respondent. Hence, the petitioner has approached this Court by filing this Writ Petition claiming reimbursement of Rs.6,67,823/- together with interest at the rate of 12% per annum for the delay period.
4. In response to the notice issued by this Court, the fifth respondent entered appearance through counsel.
5. The learned counsel appearing for the fifth respondent fairly submitted that the proposal that was forwarded by the second respondent through proceedings dated 27.07.2022 would be considered by the fifth respondent in accordance with law expeditiously.
6. In such circumstances, without going into the merits of the matter, the Writ Petition is disposed of directing the fifth respondent to take necessary action pursuant to the proceedings of the second respondent in Rc.No.15435/NHIS-3/2022, dated 27.07.2022, and pass appropriate orders and release all the eligible amounts to the petitioner as expeditiously as possible, preferably, within a period of six (6) weeks from the date of receipt of a copy of this order. No costs.
