A challenge to a tender notification becomes academic and infructuous when the concerned authority withdraws the impugned notification and issues a fresh one in its place.

Headnote:The petitioner challenged a tender notification issued by the municipal corporation under Art. 226 of the Constitution of India, alleging the package tender system was contrary to the objectives of the tender process. The court had previously granted an interim stay against the notification. The core issue was whether the challenge to the initial tender notification remained enforceable after the respondent issued a fresh notification bifurcating the work. Reasoning that the respondent had abandoned the original notification in favor of new tender conditions, the court determined that the grievance had become academic. The writ petition was disposed of as having become infructuous.

O R D E R

Heard Mr. R. Anand, learned counsel appearing for the petitioner, and Mr. N. Anandha Kumar, learned counsel appearing for the respondent.

2.The petitioner has challenged the Tender Notification dated

13.02.2025 issued by the respondent Corporation inviting bids for parking guidance, operation, and management of parking facilities. 3.Mr. N. Anandha Kumar, learned counsel appearing for the respondent, submitted that this Court, by order dated 06.03.2025, granted an interim stay of the impugned Tender Notification on the prima facie view that the package tender system adopted by the respondent appeared to run contrary to the object sought to be achieved by the tender process. It is further submitted that, subsequent to the grant of interim stay, the respondent did not proceed with the impugned tender notification and has since issued a fresh Tender Notification dated 23.04.2025 by bifurcating the work into separate packages.

4.In view of the subsequent developments, the impugned Tender Notification dated 13.02.2025 is no longer being acted upon. Consequently, the challenge raised in the present writ petition has become academic and no effective relief survives for consideration. 5.Accordingly, the writ petition stands disposed of as having become infructuous.

6.There shall be no order as to costs. Consequently, the connected miscellaneous petitions are closed.
