ORDER
This petition has been filed seeking to direct the respondents 1 and
2 to assess the property tax by issuing Patta in the name of the petitioner by rectifying the erroneous entry in the revenue records for the property of the petitioner under S.No.56/5 at Muthukulathur Taluk, Ramanathapuram District in the light of the judgment passed in A.S.No. 298/1973, A.S.No. 125/1974 and A.S.No.329/1974 on the file of the learned Principal Subordinate Court, Ramanathapuram confirming the judgment passed in O. S. No. 60/1972 on the file of the District Munsif Court, Paramakudi dated 30.11.1974.
2. The learned counsel for the petitioner submitted that the petitioner is claiming rights over the property comprised in Survey No.56/5, which is originally an ancestral property. A dispute had arisen between the petitioner’s family and one Krishna Thevar in respect of the said property. In this regard, the petitioner’s father filed a suit in O.S.No.60 of 1972 before the District Munsif Court, Paramakudi, and the suit was decreed in his favour on 23.06.1973. Challenging the said judgment and decree, the said Krishna Thevar preferred appeals in A.S.Nos.298 of 1973, 125 of 1974 and 329 of 1974 before the learned Principal Subordinate Court, Ramanathapuram. However, all the appeals were dismissed on 30.11.1974. Thereafter, no second appeal was preferred and, consequently, the litigation attained finality. The respondents 6 to 14 are the legal heirs of the said Krishna Thevar. It is further submitted that, in view of the finality attained by the civil court decrees, the petitioner has perfected title over the property and is therefore entitled to issuance of patta as well as rectification of the erroneous revenue entries.
3. Heard the learned Additional Government Pleader appearing for the respondents 1 to 5.
4. Considering the facts and circumstances of the case, this Court directs the second respondent to consider the petitioner's claim after issuing notice to the petitioner as well as the respondents 6 to 14 and pass appropriate orders in the light of the earlier civil decree, within a period of four months from the date of receipt of a copy of this order.
5. With the above directions, this Writ Petition is disposed of. No costs.
