C O M M O N J U D G M E N T
(Judgment of the Court was made by K.K.RAMAKRISHNAN,J. The accused in S.C.No. 100 of 2021, on the file of the learned Principal District and Sessions Judge, Pudukkottai have preferred the present appeal challenging the conviction and sentence imposed upon them under Section 302 read with Section 34 of the Indian Penal Code, along with a fine of Rs.2,00,000/- each, and in default, to undergo five years of simple imprisonment, as per the judgment dated 19.09.2022.
2.According to the prosecution, P.W.1 is the son of the deceased.
The first accused (A1) is the brother of the deceased, the second accused (A2) is the son of A1, and the third accused (A3) is the son-in-law of another brother of the deceased. There was a birthday function of the son of A3 on 18.09.2020. It is the further case of the prosecution that the eldest son of A1, namely Kumar, had married one Devi. Subsequently, A2 developed an illicit intimacy with the said Devi and allegedly took her to Tiruppur, where they were living together, taking advantage of the fact that Kumar was employed and residing in Malaysia. This led to a persisting dispute between the family of Kumar and that of the deceased on one side, and the accused on the other. In such circumstances, on the occasion of the said birthday function, A2 had come to the house of A1. At that time, the deceased along with P.W.1 went to the house of A1 and questioned A2 and the other accused regarding the alleged illicit relationship and the act of living together with Devi. This confrontation escalated into a quarrel, during which the accused are said to have attacked the deceased with deadly weapons. As a result, the deceased succumbed to the injuries, and P.W.1 as well as P.Ws.2 and 3 sustained injuries. Thereafter, a complaint was lodged with P.W.8, who registered a case in Crime No.523 of 2020 under Section 302 read with Section 34 IPC and informed P.W.9, the Inspector of Police. P.W.9 took up the investigation, visited the scene of occurrence, prepared the observation mahazar, seizure mahazar, and rough sketch, and conducted the inquest over the body of the deceased.
