When a registering authority officially acknowledges a document for registration in compliance with a court order, they are legally obligated to complete the ministerial registration process forthwith without further delay or obstruction.

Headnote:The present petition is filed under Art. 226 of the Constitution of India seeking a writ of mandamus for the registration of a sale deed. The case involves a petitioner whose document was kept pending by the registration authorities despite a previous court direction to the contrary. The court, upon noting that the authority had already acknowledged in writing its intent to admit the document for registration, determined that the process should be finalized without further delay. The main issue pertains to the failure of the administrative authority to execute a registration process despite confirming compliance with earlier judicial orders. The court held that once an administrative decision has been taken to admit a document for registration, the ministerial act of completing said registration must follow immediately, as the authority has no further justification to obstruct the process. The writ petition stands allowed.

Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the first respondent to complete the process of registration of the sale deed dated 14.05.2026 presented by the petitioner and kept pending by the first respondent as Doc.No.P/Kariyapatti/35/2026, strictly in compliance with the order of this Court in W.P.(MD)No.2406 of 2025, dated 28.01.2025, and pass such further or other orders.

For Petitioner : Mr.M.Ajmalkhan Senior Counsel for M/s.Ajmal Associates For R1 : Ms.P.Sudarkodi Nachiar Counsel for the Government of Tamil Nadu For R2 : Mr.S.A.Ajin Singh ORDER The writ petition has been filed seeking issuance of a Writ of Mandamus directing the first respondent to complete the registration process in respect of the sale deed dated 14.05.2026 presented by the petitioner and kept pending by the first respondent in Document No. P/Kariyapatti/35/2026, in compliance with the order passed by this Court in W.P.(MD) No.2406 of 2025 dated 28.01.2025. 2. The learned Senior Counsel appearing for the petitioner, by taking this Court through the aforesaid order passed in the earlier writ petition, submitted that this Court had directed the first respondent to register the document, subject to compliance with the conditions stipulated therein, and that the required affidavit had also been filed. In spite of the same, the document was neither registered nor released and continued to be kept pending. However, after the filing of the present writ petition, an order came to be passed by the Sub Registrar stating that, in compliance with the directions issued by this Court in W.P.(MD) No.2406 of 2025 dated 28.01.2025, the document would be admitted for registration. The learned Senior Counsel would further submit that even thereafter the registration process has not been completed and the registered document has not been handed over to the petitioner.

3. The learned counsel appearing for the second respondent also has no objection to the registration of the document.

4. The learned counsel appearing for the respondents submitted that the matter had earlier been kept pending for obtaining legal opinion.

5. However, when the Sub Registrar herself has passed an order on

29.05.2026 admitting the document for registration in compliance with the directions of this Court, the registration process shall be completed forthwith and the document shall be handed over to the petitioner. Accordingly, the writ petition stands allowed. The authority shall act upon the web copy of this order without waiting for the certified copy thereof. No costs.
