IN THE HIGH COURT OF JUDICATURE AT MADRAS
D. Bharatha Chakravarthy, J
Mary Elizabeth – Appellant
Versus
Assistant Commissioner of CGST & Central Excise – Respondent
Writ Petition

Advocates:
For the Appellants/Petitioners: S. Boominathan
For the Respondents: N. Dilipkumar

A court may direct statutory authorities to hear and decide upon a representation regarding a settlement scheme in accordance with the principles of natural justice without pre-determining the merits of the applicant's eligibility.

Headnote:The petitioner filed a writ petition under Art. 226 of the Constitution of India seeking a mandamus to direct the respondent to consider a representation regarding the Sabka Vishwas (Legacy Dispute Resolution) Scheme. The court noted the request of the petitioner to settle the issue and the respondent's willingness to consider the eligibility and merits of the representation. Regarding the issue of whether a mandamus should be issued to compel administrative consideration of a settlement scheme application, the court reasoned that the matter could be disposed of without expressing an opinion on the merits. The court held that the authority must consider the representation and grant the petitioner an opportunity of hearing. In the result, the petition was allowed directing the respondent to pass orders on the representation within three months.
