ORDER

This Writ Petition has been filed seeking the issuance of a Writ of

Mandamus directing the first respondent, namely, the Joint Director of School Education (Personnel), Chennai, to sanction provisional pension to the petitioner in terms of Rule 69(1)(a) of the Tamil Nadu Pension Rules, 1978, from the date of the proceedings in R.C. No. 065968/C3/S1/2023 dated 24.10.2025 issued by the Joint Director of School Education (Personnel), Chennai, whereby the petitioner was permitted to retire from service without prejudice to the pendency of the disciplinary proceedings against him, which are to be continued under the Tamil Nadu Pension Rules, 1978, within such

time as may be fixed by this Court.

2. The petitioner was placed under suspension on the last day of

his service and was not permitted to retire from service. Subsequently, the order of suspension was revoked, and he was allowed to retire from service without prejudice to the disciplinary proceedings pending against him. The petitioner is now seeking to sanction of provisional pension under Rule 69(1)(a) of the Tamil Nadu Pension Rules, 1978. The petitioner's request shall be considered

by the respondents in accordance with the said Rule.

3. Accordingly, the first respondent is directed to consider the

petitioner's claim in the light of Rule 69(1)(a) of the Tamil Nadu Pension Rules, 1978, on its own merits and in accordance with law. Such exercise shall be completed within a period of eight (8) weeks from the date of receipt of a copy

of this order.

4. With these directions, this writ petition is disposed of. No costs.
