A review application is maintainable only if there is an error apparent on the face of the record, and the court cannot re-hear the case on merits under the guise of review.

Headnote:The petitioner filed a review application seeking to review the earlier order dated 12.09.2019 passed in the writ petition. The court analyzed whether there existed any error apparent on the face of the record as per the requirements of Order 47 Rule 1 & 2 of the Code of Civil Procedure, 1908. The issue for consideration was whether the grounds presented by the review petitioner warranted a review of the previous judgment. Upon examination, the court held that no error apparent on the face of the record could be established, noting that the power of review is limited to correcting manifest errors of law or fact. The review application is dismissed.
