When a competent statutory authority has determined festival entitlement rights, revenue authorities in a peace committee meeting must align their orders with such findings rather than overriding them through conflicting directives.

Headnote:The petitioner challenged an order passed by the revenue authority regarding the conduct of a temple festival, which directed the proceedings to follow a previous court judgment, ignoring a subsequent order passed by the jurisdictional endowment authority. The court examined the conflict between the revenue authority’s peace committee order and the existing adjudication by the Hindu Religious and Charitable Endowment Department. The court framed the issue as whether the revenue authorities are empowered to disregard an order passed by the statutory endowment authority regarding temple festival entitlements. The court determined that revenue authorities must defer to the orders of the specialized statutory department (the Commissionerate/Department of Hindu Religious and Charitable Endowment) when a valid determination has been made regarding festival entitlements. The ratio decidendi established that once a competent statutory authority has settled the issue of ritual/festival performance rights, revenue authorities acting under peace-keeping powers cannot override such findings. The court set aside the impugned order and directed the festival to be conducted in accordance with the prior order issued by the jurisdictional endowment authority, while ensuring no parties are prevented from participating in worship and mandating police protection for the event.

PRAYER : Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, to call for the records relating to the impugned peace talk decision in Na.Ka.145/2021/A2 dated 02.06.2026 of the 3rd respondent, quash the same as illegal and consequently direct the 7th respondent to conduct Vaigasi Visagam festival of Arulmighu Muthu Mariamman Temple in Mangudi Village, Poovatrakudi Post, Keeramangalam Via, Aranthangi Taluk, Pudukkottai District from 14.06.2026 to 26.06.2026 as per original Mandagapadi existing in the temple.

ORDER

Challenging the impugned order passed by the 3rd respondent dated 02.06.2026 and consequently direct the 7th respondent to conduct Vaigasi Visagam festival of Arulmighu Muthu Mariamman Temple in Mangudi Village, Poovatrakudi Post, Keeramangalam Via, Aranthangi Taluk, Pudukkottai District from 14.06.2026 to 26.06.2026 as per original Mandagapadi existing in the temple, this writ petition is filed.

The impugned order is all about a peace committee conducted by the 3rd respondent between A, B & C parties pertaining to the conduct of temple festival at Arulmighu Muthu Mariamman Temple in Mangudi Village, Poovatrakudi Post, Keeramangalam Via, Aranthangi Taluk, Pudukkottai District from 14.06.2026 to 26.06.2026. After conducting the peace committee, the impugned order came to be passed directing the 7th respondent to conduct the festival in terms of the order passed by this Court in W.P.Crl.(MD)No.88 of 2025, dated 06.06.2025. Challenging the same, this writ petition is filed by the petitioner.

The learned counsel for the petitioner submitted that without considering the order passed by the 5th respondent in O.A.No.74 of 2021 by order dated 21.07.2025, the 3rd respondent had passed the impugned order. When the matter has already been settled by the appropriate authorities, it is for the revenue authorities to follow the same. Having not considered the same, the revenue authorities had unnecessarily passed the impugned order by directing the 7th respondent to conduct the festival in terms of the order passed by this Court in W.P.Crl.(MD)No.88 of 2025. The aforesaid order was passed by this Court when the said O.A.No.74 of 2021 was pending before the 5th respondent, and now that the 5th respondent has already dealt with the issue and had settled the matter regarding the grant of Mandagapadi to the various claimants, including A, B & C parties. The impugned order is absolutely illegal and the same should be set aside. Hence, this writ petition.

4. The learned counsel appearing for the 7th respondent fairly conceded the same.

The learned counsel appearing for the 9th respondent categorically contended that they are negated by the petitioner as well as the 7th respondent from offering Mandagapadi during the temple festival and they were not at all given an opportunity to participate in the temple festival. He further submitted that the order passed by the 5th respondent in O.A.No.74 of 2021 dated 21.07.2025 has been challenged by preferring an appeal in A.P.No.51 of 2025 before the Commissioner, Hindu Religious and Charitable Endowment Department.
