PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus to direct the respondent to consider the petitioner's representation dated 08.05.2026 and dispose the petitioner application dated 10.11.2025 seeking revision of plan pertaining to the property at Plot No.21, T.S.No.551/1 part, 556/2 part, Block No.7, Melapalayam Ward, Tirunelveli Municipality, Tirunelveli District within a stipulated time to be fixed by this Court.

The petitioner has filed the present Writ Petition seeking a direction to the respondent to consider the petitioner's representation dated 08.05.2026 and dispose of the application dated 10.11.2025 seeking revision of the building plan pertaining to the property situated at Plot No.21, T.S.Nos.551/1 (Part) and 556/2 (Part), Block No.7, Melapalayam Ward, Tirunelveli Municipality, Tirunelveli District.

2. The petitioner is the owner of the property bearing Door No. 40A/1, Jeba Nagar, Block No.7, Melapalayam Ward, Tirunelveli. He had obtained planning permission for construction of a residential building vide PPA No. 14/TP3 dated 11.02.2014 and the corresponding Building Permit No.831/13/TP3 dated 11.02.2014, pursuant to which he completed the construction. Subsequently, at the instance of a neighbouring property owner, the Local Planning Authority issued notices and initiated enforcement action against the petitioner. Aggrieved by the said action, the petitioner preferred an appeal before the Appellate Authority, namely the Secretary to Government, Housing and Urban Development Department. By proceedings in Letter No.15004/UD4(1)/2018-3 dated 27.09.2019, the Government directed the respondent to de-seal the building and further directed the petitioner to obtain a revised plan after carrying out the necessary rectifications.

3.Thereafter, the petitioner approached the respondent for submission of the revised plan application in person. However, he was instructed to submit the application through the online portal. According to the petitioner, despite several attempts, he was unable to successfully submit the application online. Consequently, he forwarded the revised plan application along with all necessary enclosures and requisite charges through Speed Post on 10.11.2025. Since no action was taken on the said application, the petitioner has approached this Court by filing the present Writ Petition.

In view of the above, and without expressing any opinion on the merits of the petitioner's claim, this Court directs the respondent to consider and dispose of the petitioner's application seeking revision of the building plan in respect of the property comprised in T.S.Nos.551/1 (Part) and 556/2 (Part), Block No.7, Melapalayam Ward, Tirunelveli Municipality, Tirunelveli District, and pass appropriate orders on merits and in accordance with law, after affording the petitioner an opportunity of personal hearing. Such exercise shall be completed within a period of four (4) months from the date of receipt of a copy of this order.

5. With the above directions, the Writ Petition stands disposed of. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
