Prayer: Writ Petition filed under Article 226 of the Constitution of India seeking issuance of writ of certiorarified mandamus, to call for the entire records of impugned order bearing No. TR No 2024/ 0103.05.262439 / TR dated 03.06.2024 on the file of third respondent and quash the same and consequently direct the 4th respondent to issue separate patta in petitioner favour in respect of property bearing Survey No.32/2 measuring 5850 ¾ sq.ft under patta No.545 situated at Irulapatti Village, Papireddipatti Taluk, Dharmapuri District.

ORDER

1. This Writ Petition has been filed challenging the order dated 03.06.2024 of the 3rd respondent and consequently direct the 4th respondent to issue separate patta in petitioner’s favour in respect of property bearing Survey No.32/2 measuring 5850 ¾ sq.ft under patta No.545 situated at Irulapatti Village, Papireddipatti Taluk, Dharmapuri District.

2. Though the petitioner filed this writ petition for a larger relief, the learned counsel for the petitioner would submit that he restricted his relief, since after issuing patta to the third parties to the subject land where, the petitioner also obtains patta and requested this Court to issue a direction to the Revenue Divisional Officer to consider and pass appropriate orders on the petitioner’s representation dated 03.12.2025 which was filed for the purpose of cancellation of patta before the Revenue Divisional Officer.

3. The learned counsel appearing for the respondents would submit that since the petitioner has restricted his relief, the respondent will dispose of the representation made by the petitioner on 30.12.2025 for cancellation of patta and appropriate directions will be issued.

4. In view of the same, without going into the merits of the matter, this Court directs the Revenue Divisional Officer / 2nd respondent to consider the petitioner’s representation dated 30.12.2025 and pass appropriate orders on the same, within a period of twelve weeks from the date of receipt of a copy of this order, after issuing notice to the parties concerned.

5. This Writ Petition is disposed of with the above terms. No costs. Consequently, connected miscellaneous petition is closed.
