IN THE HIGH COURT OF JUDICATURE AT MADRAS
G.K. Ilanthiraiyan, J
K.P. Ragunathan – Appellant
Versus
Commissioner of Police – Respondent
W.P.Crl. No. 720 of 2026

Advocates:
For the Appellants/Petitioners: Ravindranath Jeyapal
For the Respondents: R.Ganesh Kumar

The High Court may issue a direction to statutory authorities to consider and dispose of a pending representation for police protection within a specified timeframe, without adjudicating the necessity of such protection on merits.

Headnote:The present petition is filed under Article 226 of the Constitution of India, seeking a Writ of Mandamus to direct police authorities to provide protection, including armed guards, following an unaddressed representation dated 04.12.2025 citing threats to life and limb. The Court, upon reviewing the submissions, declined to examine the merits of the underlying dispute at this stage. Instead, the Court directed the respondent police authority to consider and dispose of the pending representation on its own merits. The core issue is whether the Court should compel a statutory authority to act upon a pending representation for security. The ratio decidendi established here is that, without expressing an opinion on factual merits, it is sufficient to direct the relevant respondent to process the application in accordance with law within a stipulated time frame, thereby preserving the administrative process. The petition is disposed of with a direction to the respondent to pass appropriate orders on the representation within two weeks.
