PRAYER: Writ Petition is filed under Article 226 of Constitution of India, praying for the issuance of Writ of Mandamus directing 1st to 3rd respondents to provide adequate police protection to the petitioners life and her property situated at No. 28, Sakthi Nagar, Thandurai, Pattabiram, Chennai - 600 072, against the illegal threats and interference caused by the 4th respondent and his associates, by considering the petitioners representation dated 04.08.2023.

ORDER

This Writ Petition has been filed seeking a direction to the respondents 1 to 3 to provide adequate police protection to the petitioner’s life and property situated at No. 28, Sakthi Nagar, Thandurai, Pattabiram, Chennai - 600 072, against the alleged illegal threats and interference caused by the fourth respondent and his associates, by considering the petitioner’s representation dated 04.08.2023.

2. It is seen from the records that the fourth respondent is the brother of the petitioner and that there exists a property dispute between them. According to the petitioner, the subject property is her self-acquired property. It is further alleged that the fourth respondent, who is stated to be an accused a murder case, has been threatening the petitioner. In this regard, it is submitted that a complaint had already been lodged by the petitioner and the same is pending investigation in Crime No.427 of 2022 on the file of the third respondent.

3. The petitioner further alleged that the fourth respondent once again interfered with her peaceful possession and enjoyment of the property and continued to threaten her, pursuant to which another complaint dated 04.08.2023 was lodged before the third respondent.

4. Since the complaint dated 04.08.2023 has not been considered till date, this Court is inclined to grant liberty to the petitioner to submit a fresh complaint before the third respondent. Upon receipt of such complaint, the third respondent shall consider the same and proceed in accordance with law, as expeditiously as possible.

5. With the above direction, this Writ Petition (Criminal) stands disposed of. No costs.
