The court directed further investigation in an ongoing criminal case, contingent upon the complainant's cooperation and submission of requisite evidence, under the power to ensure a fair and comprehensive criminal investigation.

PRAYER: Writ Petition is filed under Article 226 of Constitution of India, praying for the issuance of Writ of Mandamus to direct the 2nd respondent to conduct further investigation in Crime No.131 of 2021 on the file of 2nd respondent and pursuant to the petitioner representation dated 13.01.2025.

ORDER

This Writ Petition has been filed seeking a direction to the second respondent to conduct further investigation in Crime No.131 of 2021 on the file of second respondent, pursuant to the petitioner’s representation dated 13.01.2025.

2. It is the case of the petitioner that he is also one of the victims in the job racketing scam allegedly committed by the accused. According to the petitioner, he had paid a sum of Rs. 5,00,000/- to the second accused for securing a Government Job.

On the complaint lodged by one of the victims, namely the third respondent, the second respondent registered an FIR in Crime No.131 of 2021 for the offences under Sections 406, 420, 465, 468 read with Section 34 of IPC. After completion of investigation, a final report was filed and the case has been taken on file in C.C.No.120 of 2024 on the file of the learned Judicial Magistrate No.1, Tambaram, and the same is pending for trial.

While the matter was pending trial, the petitioner lodged a complaint before the second respondent alleging that he had also paid a sum of Rs.5,00,000/- to second accused for securing a Government Job. Pursuant to the said complaint, the second respondent issued summons to the petitioner on 03.04.2025, 10.04.2025 and 28.04.2025 for enquiry. However, despite receipt of the summons, the petitioner did not appear before the second respondent for enquiry.

The learned Government Advocate (Criminal Side) appearing for the respondents 1 and 2 submitted that the petitioner is also treated as one of the victims in the case and that summons had already been issued to him for the purpose of enquiry. However, the petitioner failed to cooperate with the investigation.

In view of the above, the petitioner is directed to appear before the second respondent for the purpose of investigation within a period of two weeks from the date of receipt of a copy of this order and produce all relevant documents / materials to substantiate his claim that he had paid a sum of Rs.5,00,000/- to the accused for securing a Government Job.

7. On such appearance and upon receipt of the relevant materials from the petitioner, the second respondent is directed to conduct further investigation, if required and file an additional final report / charge sheet before the Trial Court, if warranted, within a period of twelve (12) weeks thereafter.

8. With the above directions, this writ petition stands disposed of.

No costs.
