A Writ of Mandamus seeking action against officials for an allegedly false status report is not maintainable when records indicate the underlying grievance was investigated and the report contained no falsehoods.
Headnote:The petitioner filed a writ petition under Article 226 of the Constitution of India seeking a Writ of Mandamus to direct official respondents to initiate action against police officers for allegedly submitting a false status report in a prior legal proceeding. The Court examined the records and the status report in question. The central issue was whether the report filed by the police contained false averments necessitating disciplinary action. Upon scrutiny, the Court observed that the initial complaint had been duly inquired into and subsequently closed, finding no evidence of falsity in the submitted report. The court dismissed the petition.
