The High Court may issue a direction in a writ of mandamus for public authorities to consider and dispose of a pending representation within a specified timeframe, without prejudice to the merits of the underlying dispute.

Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the Respondents 1 and 2 to issue Patta for the property belonging to the petitioner the land comprised in S.No.33/1A Classified as Gramanatham, situated in old No.187, New No.149 Serappanacheri Village, Sriperumbudur Taluk, now kundrathur Taluk, Kundrathur Municipality, Kancheepuram District to the Petitioner by removing the illegal construction built for the Office of the 4th Respondent by the 5th Responded under the guise of the Public purpose in view of the considering the petitioner representation dated 19.06.2024

ORDER

This writ petition has been filed to direct the respondents to consider the petitioner's representation dated 19.06.2024.

2. Mr.M.Senthamizh Selvan, learned Government's counsel, takes notice on behalf of the respondents 1 to 4.

3. By consent of the parties, the main petition is taken up for disposal in the stage of admission itself.

4. The learned counsel for the petitioner would submit that in this case, the petitioner filed a representation dated 19.06.2024 before the 1st & 2nd respondent, requesting for issuance of patta pertaining to the subject property. However, the said representation was not at all considered by the 1st & 2nd respondents till date. Hence, this petition.

5. In reply, the learned counsel for the respondent would submit that the petitioner’s representation will be disposed of within a period of 8 weeks and hence, she requests this Court to pass appropriate orders.

6. Heard the learned counsel appearing for the petitioner as well as the respondent and also perused the entire materials available on record.

7. In view of the above, without expressing any opinion on the merits of the matter, this Court directs the 1st respondent to consider the representation of the petitioner dated 19.06.2024 and dispose of the same, on merits and in accordance with law, within a period of 8 weeks from the date of receipt of a copy of this order.

8. With the above directions, this writ petition is disposed of. No cost.
