ORDER
(Order of the Court was made by Sunder Mohan J.)
Suo Motu Contempt proceedings initiated against the contemnor herein as per order dated 17.02.2020 of the Hon’ble the Chief Justice in Roc.No.1278/2020/OS.
By order dated 10.02.2026, our predecessor Bench disposed of the above contempt petition. Read this order in continuation and in consonance with the said order.
2. As could be seen from the order dated 10.02.2026, the respondent/contemnor was found guilty of contempt and this Court had rendered one opportunity to the contemnor to purge himself of the contempt by tendering an unconditional apology, failing which, the contemnor would be sentenced to simple imprisonment of one month without further reference.
3. It is seen from the records that on 09.03.2026, the contemnor had filed a memo in which he had stated thus, ‘ I apologise.’
4. This Court on 09.03.2026 did not accept the memo, as what was directed to be filed was only an affidavit and had also recorded the fact that the contemnor agreed to file an affidavit within two weeks from the said date.
5. The contemnor had filed an affidavit on 27.03.2026 in the Registry. The Contemnor is present in Court, today. Paragraph 5 of the affidavit reads as follows:
“5. The contemnor submits that he wishes to bring his part of the sordid proceedings over the years to an end and bury the same by explicitly stating the following:
“I hereby solemnly affirm and sincerely state that I genuinely regret having made and shall not make any such allegations or statements against the Hon’ble Court and the Hon’ble Lord Justices in future of accusing them of genocide and crime against humanity. Unconditional apology to not to repeat the same and for hurting the Hon’ble Lord Justices. It does not relate to judicial orders. However, shall refrain from slandering the orders already passed by this Hon’ble Court. It is sincerely hoped that this apology is accepted in the facts and circumstances of this case and the Suo Motu Contempt Petition No.391 of 2020 closed.”
6. The said affidavit is accepted and is treated as compliance of the earlier directions of this Court dated 10.02.2026 to purge the respondent of contempt. Hence, the Contempt Petition is closed. However, it is made clear that if the contemnor violates the affidavit of undertaking, which is recorded above, he shall be sentenced to one month simple imprisonment as observed by this Court vide order dated 10.02.2026.
