This Civil Revision Petition has been filed seeking for an early disposal of H.M.O.P. No.37 of 2024 pending on the file of the Principal Sub Judge, Ponneri.

2.The petitioner is the husband and the respondent is his wife. The petitioner has filed H.M.O.P. No.37 of 2024 seeking for dissolution of marriage with his wife. Earlier, the matter was referred to mediation, but the mediation also failed. The petitioner claims the till date, counter has not been filed by the respondent in H.M.O.P. No.37 of 2024.

3.This Court, after giving due consideration to the year of the H.M.O.P. is of the considered view that no prejudice would be caused to any of the parties if a direction is issued to the Principal Sub Judge, Ponneri to dispose of H.M.O.P. No.37 of 2024 within a time frame to be fixed by this Court.

4.Accordingly, this Court directs the respondent to file counter in H.M.O.P. No.37 of 2024 within a period of four weeks from the date of receipt of a copy of this order and on receipt of the counter within the stipulated time, the Principal Sub Judge, Ponneri is directed to dispose of H.M.O.P. No.37 of 2024 within a period of one year thereafter. If the counter is not filed by the respondent within a period of four weeks from the date of receipt of a copy of this order, the Principal Sub Judge, Ponneri is also directed to proceed with the H.M.O.P. No.37 of 2024 in the absence of the counter and dispose of the same as directed by this Court supra. No costs.
