ORDER
PRAYER : Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the 4th respondent to consider the petitioner's representation dated 30.05.2026 and consequently provide adequate police protection to Mahalakshmi College of Nursing and Allied Health Science, its management, staff members, faculty members and students in order to ensure the peaceful functioning of the institution and maintenance of law and order.
2. The learned counsel appearing for the petitioner submitted that the petitioner is running Mahalakshmi College of Nursing and Allied Health Science, which has been functioning since the year 2021 under the management of a Trust. During May 2026, the management discovered serious financial and administrative irregularities allegedly committed by the former Principal and certain persons associated with her. Consequent to the said developments, disturbances continued to prevail in the administration of the institution. Apprehending threats from the rival group, the petitioner submitted a representation dated 30.05.2026 to the respondent police seeking adequate police protection. However, no action was taken on the said representation.
3. In the interregnum, yesterday, ie., on 10.06.2026 at about 10.00 p.m., certain miscreants allegedly trespassed into the college premises and set fire to the Principal's room. Pursuant thereto, a case was registered in Crime No. 211 of 2026 by the fourth respondent police. In the above circumstances, the petitioner has approached this Court seeking the relief prayed for in the present petition.
4. The learned Government Advocate appearing for the respondent police submitted that the respondent police will look into the matter and provide adequate police protection.
5. Considering the facts and circumstances of the case, the third respondent police is directed to issue notices to the parties concerned under Section 64 of the BNSS, conduct an enquiry, and conclude the same within a period of four weeks from the date of receipt of a copy of this order. Upon conclusion of the enquiry, the fourth respondent police shall afford appropriate police protection to the petitioner college, subject to payment of the requisite charges, in accordance with G.O.Ms.No.139, Home (Pol-VIII) Department, dated 04.03.2019.
6. At this juncture, it is also brought to the notice of this Court by the learned counsel by the petitioner that already a complaint in this regard has been lodged by the college administration and the same is pending before the third respondent and the third respondent is directed to dispose of the same after conducting a discreet enquiry within a period of four weeks from the date of receipt of a copy of this order.
7. With the above direction, this writ petition stands disposed of. Consequently, connected miscellaneous petition is closed.
