PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 5 to consider the petitioner's representation dated 11.03.2016 and consequently to remove the encroachments made in the public pathway comprised in S.No.147/2 situated at Irumbali Village, Sathiyamangalam Taluk, Kulathur Taluk, Pudukkottai District forthwith within the time frame fixed by this Court.

ORDER

This writ petition has been filed seeking a direction to the respondents 1 to 5 to remove the encroachments made in the public pathway comprised in S.No.147/2 situated at Irumbali Village, Sathiyamangalam Taluk, Kulathur Taluk, Pudukkottai District by considering the petitioner's representation dated 11.03.2016.

2.Today, when the matter is taken up for hearing, the learned Counsel for the State submits that survey has already been conducted in the subject property and some encroachments are identified. He further submitted that appropriate action would be taken to remove such encroachment.

3.In view of the above submission, the authorities concerned are directed to take necessary action for the removal of the encroachment, after affording sufficient opportunity of personal hearing to all the parties concerned and by following due process of law, within a period of three months from the date of receipt of a copy of this order.

4.With the above direction, this writ petition is disposed of. There shall be no order as to costs.
