PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 to 4 to remove the encroachments and unauthorized construction in the 20 feet public road in between Plot No.5 and Plot No.12 on the southern side of the petitioner's land situated at Town Survey No.1503/3, 4, 5, Pallapatti Village, Dindigul West Taluk, Dindigul District, by considering the petitioner's representation dated 28.03.2026 within the time stipulated by this Court.

ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.)

1. The prayer in this writ petition is to issue a Writ of Mandamus, directing the respondents 1 to 4 to remove the encroachments and unauthorized construction in the 20 feet public road in between Plot No.5 and Plot No.12 on the southern side of the petitioner's land situated at Town Survey No.1503/3, 4, 5, Pallapatti Village, Dindigul West Taluk, Dindigul District, by considering the petitioner's representation dated 28.03.2026 within a time frame.

2. Learned Standing Counsel appearing for the 2nd respondent Corporation would submit that the 2nd respondent will consider the representation of the petitioner, inspect the site in question and if there is any unauthorised construction therein, after hearing both sides, appropriate action will be taken for removal of the same.

3. In such a view of the matter, let the 2nd respondent issue notice to the petitioner and 5th respondent, make an inspection/survey of the place in question in their presence. If the survey/inspection reveals any unauthorised construction, the 2nd respondent shall take steps to remove the same after giving opportunity to both sides including the 5th respondent. Such an exercise shall be completed within a period of two months from the date of receipt of a copy of this order.

4. With the above direction, the Writ Petition is disposed of. No costs.
