ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.)

PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, seeking direction to the Respondents herein to remove the encroachment made in the road bearing Survey No.278, Keelapaguthi Village, Kadavoor Taluk, Karur District within a stipulated time as prescribed by this Honble Court by considering the petitioner's representation dated 07/07/2025.

2. According to the petitioner, the private respondents have encroached upon the road in the abovesaid survey number by putting up fencing. Despite the authorities issued notice to them and police protection is sought, the encroachment is not so far removed. According to the petitioner, the land in the subject survey number was gifted to the local body.

3. We have perused the communications of the 2nd respondent/BDO to the 4th respondent/Inspector of Police to accord necessary police protection to remove the encroachment which are as early as on 27.01.2026 and 19.02.2026 respectively. However, nothing is fructified so far and the encroachment is not removed.

4. Since the encroachment has already been identified and notices have also been issued to the private respondents, let the authorities remove the encroachments forthwith with police protection. The 4th respondent/Inspector of Police is directed to provide necessary police protection to the 2nd respondent for removing the encroachments. Such an exercise shall be completed within a period of two months from the date of receipt of a copy of this order.

5. With the above direction, the Writ Petition is disposed of. No costs.
