PRAYER: This criminal original petition filed under Section 528 of BNSS to call for records and set aside the order dated 08.04.2026 passed in Crl.M.P.No.2637/2026 in C.C.No.1546/2019 the Learned Judicial Magistrate No.VII, Coimbatore by allowing this petition and thus render justice.

ORDER

The petitioner/accused, facing trial in CC No.1546 of 2019, filed a petition under Section 311 Cr.P.C to recall PW10 & PW33. The trial Court by order dated 08.04.2026 dismissed the petition.

The contention of the petitioner is that the petitioner is facing trial for offences under Sections 120B, 468, 471, and 420 IPC as though the petitioner created documents and also projected that he could get admission for children in the school and collected money and thereafter, cheated him. He further submitted that in this case, PW10 is one of the witnesses, who was later included and he produced a receipt during the chief examination and it was marked as Ex.P2. This Ex.P2 is not relied upon document, which was furnished to the petitioner and hence, the petitioner was unable to cross examine the witness immediately and sought the copy of the document and sought sometime to cross examine.
