Civil Revision Petition filed under Article 227 of the Constitution of India to set aside the return order dated 05.06.2023 of the Principal Sub Judge, Villupuram in unnumbered O.S.(F) No.1060 of 2023 and consequently direct the Principal Sub Judge, Villupuram to take on record the Plaint and number the said suit.

ORDER

This Civil Revision Petition has been filed, challenging the non numbering of the suit filed by the petitioner in O.S.(F) No.1060 of 2023, pending on the file of the Principal Sub Court, Villupuram.

It is now represented by the learned counsel for the petitioner that subsequent to the filing of this Civil Revision Petition, a fresh suit was filed by the petitioner against the respondent in respect of the very same cause of action and the said suit has been numbered as O.S. No.140 of 2026 on the file of the Principal Sub Court, Villupuram.

3. In view of the same, nothing survives for further adjudication in this Civil Revision Petition. After recording the fact that the petitioner has filed a subsequent suit in respect of the very same cause of action, which has been numbered as O.S. No.140 of 2026 on the file of the Principal Sub Court, Villupuram, this Civil Revision Petition is closed. No costs.
