IN THE HIGH COURT OF JUDICATURE AT MADRAS
L. Victoria Gowri, J
Rajappan – Appellant
Versus
Superintendent of Police – Respondent
W.P.Crl.(MD)No.3012 of 2026
For the Appellants/Petitioners: A.B.Jeeva
For the Respondents: D.Rajaboopathy
The High Court may issue directions for effective and time-bound police investigation under its writ jurisdiction when allegations of insufficient progress in a criminal case are brought forward, without necessarily ordering a transfer of investigation.
Headnote:The petitioner filed a petition under Article 226 of the Constitution of India seeking for the transfer of an investigation in a criminal case, alleging inadequate action by the investigation agency regarding a financial fraud complaint. The Court noted that an FIR had been registered, and upon considering the facts, found it appropriate to issue directives for a timely and fair investigation. The core issue before the Court was whether the investigation into the reported crime should be transferred. The Court reasoned that instead of transferring the case, the ends of justice would be met by ensuring the current investigation is conducted properly, transparently, and supervised by a superior authority, citing procedural requirements under the relevant criminal code. The writ petition is disposed of with directions for the investigation to be completed within four weeks.
