PRAYER: The Writ Petition is filed under Article 226 of the Constitution of India seeking the issuance of a Writ of Mandamus directing the respondents to reckon the calculation with 12 percent of Dearness Allowances as ordered in G.O. Ms. No.247 dated 13.11.2025 for settlement of service Gratuity and leave Salary and to pay the monetary value of 3 percent of increased dearness allowance with 6 percent interest per annum from the date of retirement, in the light of judgment passed by this Court on 25.08.2022 in W.P. No.14421 of 2022.
ORDER
The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus to consider the petitioner’s representation dated 17.03.2026 and to pass appropriate orders.
2. The case of the petitioner is that he was appointed on 29.08.1992 and retired on attaining the age of superannuation on 30.09.2025. His terminal benefits were disbursed only after a delay of about five months and without payment of interest. The gratuity and earned leave encashment were calculated at 55% DA, whereas under G.O.Ms.No.247 dated 13.11.2025, they ought to have been calculated at 58% DA, resulting in a shortfall of approximately Rs.52,329/-.
3. The petitioner relies upon the order of the High Court in W.P. No. 14421 of 2022 dated 25.08.2022, wherein the respondents were directed to pay 6% interest per annum for delayed settlement of terminal benefits. Thereafter, on 17.03.2026, the petitioner submitted representations to the respondents seeking payment of the differential amount and interest for the delayed disbursement of terminal benefits. However, no action was taken by the respondents, compelling the petitioner to approach the Court.
4. Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the 1st respondent and the learned Standing Counsel appearing for the respondents 2 and 3.

Considering the facts and circumstances of the case and the submissions made by the learned counsel appearing for both sides, this Court directs the respondents to consider the representation of the petitioner dated 17.03.2026 and pass appropriate orders, on merits and in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order. If the petitioner is found eligible, the amount shall be disbursed within a period of six (6) weeks thereafter.
6. With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
