A Writ of Mandamus may be issued to direct authorities to consider and pass orders on a representation seeking service regularization where such representation has remained unaddressed, without the Court expressing an opinion on the merits of the underlying claim.

PRAYER: The Writ Petition is filed under Article 226 of the Constitution of India seeking the issuance of a Writ of Mandamus directing the respondents to consider and pass order on the petitioner representation dated 03.03.2025 and regularize the service of the petitioner in the post of Plot Watcher as per G.O.Ms.No.95, Environment and Forest Department dated 07.08.2009 and G.O.Ms.No.202, Environment and Forest (FR-2) Department, dated 18.12.2013 with all consequential benefits.

ORDER

The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus to consider the petitioner’s representation dated 03.03.2025 and to pass appropriate orders.

The case of the petitioner is that he submitted a representation to the respondents dated 03.03.2025 seeking regularization of his service in the post of Plot Watcher as per G.O.Ms.No.95, Environment and Forest Department dated 07.08.2009 and G.O.Ms.No.202, Environment and Forest (FR-2) Department, dated 18.12.2013, with all consequential benefits. However, the respondents has not considered the same till date. Challenging the inaction on the part of the respondents, the petitioner is constrained to file the present Writ Petition.

3. Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondents.

Considering the facts and circumstances of the case and the submissions made by the learned counsel appearing for both sides, this Court, without going into the merits of the case, directs the 2nd respondent to consider the representation of the petitioner dated 03.03.2025 seeking regularisation of his service and pass appropriate orders, on merits and in accordance with law, within a period of six (6) weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
