The jurisdictional Tahsildar is the competent authority to conduct surveys and execute the removal of encroachments on government poramboke land, as administrative functions involving coercive measures cannot be delegated to the Block Development Officer.

Headnote:The petitioner filed this writ petition under Article 226 of the Constitution of India challenging the administrative recommendation for reclassifying government road poramboke land to Natham poramboke for the purpose of granting patta to alleged encroachers. The court examined the authority of the Tahsildar versus the Block Development Officer in initiating eviction proceedings for encroachment removal. The court framed the issue regarding the appropriate statutory authority empowered to execute the removal of encroachments on government land. The ratio decidendi established by the court is that the Tahsildar, as the primary revenue authority, holds the legal mandate and responsibility to conduct surveys and undertake the removal of encroachments, ruling out the transfer of such coercive powers to the Block Development Officer. The writ petition is disposed of with a direction to the third respondent to conduct a survey upon notice to all parties and complete the encroachment removal process within four months if found necessary.
