Prayer :Petition filed under Article 226 of the Constitution of India. to issue a writ of Habeas Corpus, directing the respondents to produce the body or person of the petitioner's daughter the detenue, Ilamathi, D/o. Subramani (aged about 23 years) before this Court and to set her at liberty.

ORDER

(Order of the Court was made by N. ANAND VENKATESH,J.)

This Habeas Corpus Petition has been filed for a direction to the respondents to produce the body or person of the petitioner's daughter and to set her at liberty.

2. The case of the petitioner is that the petitioner is the mother of the detenu and on 16.05.2026, the petitioner's daughter left home and thereafter, did not return back. In spite of best efforts, her whereabouts was not able to be ascertained. Hence, a complaint was given before the third respondent and a woman missing FIR was registered in Crime No.189 of 2026. Since no effective steps were taken to find the whereabouts of the detenue, the present Habeas Corpus Petition has been filed.

3. Heard the learned counsel on either side.

4. The learned counsel for the State of Tamil Nadu (Criminal Side) submitted that the detenue got married to one Mohammed Yunis and that she is now staying at Abu Dhabi along with him. The learned counsel further submitted that the third respondent is awaiting for the report from the Immigration Department in order to proceed further with the case.

5. Taking into consideration the facts and circumstances of the case and considering the nature of grievance expressed by the petitioner and considering the submissions made by the learned counsel for the State of Tamil Nadu (Criminal Side), there shall be a direction to the third respondent to produce the detenue before the learned Additional Mahila Judge, Sivagangai as expeditiously as possible. The learned Judge shall record the statement of the detenue and proceed further in accordance with law.

6. This Habeas Corpus Petition stands disposed of in the above terms.
