Prayer :Petition filed under Article 226 of the Constitution of India. to issue a writ of Certiorarified Mandamus, calling for the records pertaining to the impugned order of the first respondent dated 14.05.2026 in No.421/UTHA. 2/2026 and quash and modify the same and consequently direct the respondents to grant ordinary leave of 28 days without escort to the petitioner's husband, the prisoner namely, Paulraj s/o. Aaththi PID No. 17181, presently serving life sentence at Palayamkottai Central Prison.

This writ petition has been filed challenging the impugned proceedings of the first respondent made in No.421/UTHA.2/2026 dated 14.05.2026 and for a consequential direction to the respondents to grant ordinary leave for 28 days without escort to the petitioner's husband, who is presently serving sentence at Central Prison, Palayamkottai,

2. Heard the learned counsel on either side.

3. The petitioner's husband is a life convict and he is presently serving sentence at Central Prison, Palayamkottai. The petitioner made a representation to the respondents seeking for 28 days ordinary leave on the ground that the petitioner is facing health issues and some financial arrangements will have to be made. The representation made by the petitioner came to be considered by the first respondent and 28 days ordinary leave was granted subject to the condition that the convict will be accompanied by an escort. This condition has been put to challenge in the present writ petition.

Taking into consideration the facts and circumstances of the case and considering the fact that the convict has undergone sentence of 11 years, 1 month and 15 days and ordinary leave was granted once and nothing untoward took place, we are inclined to modify the condition imposed by the first respondent to the effect that the convict will report before the fourth respondent daily at 05.00 p.m., during the entire ordinary leave period. The other conditions imposed by the first respondent shall stand as it is.

5. This writ petition (criminal) stands disposed of in the above terms.
