Prayer: Criminal Original Petition is filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 to extend the time to furnish sureties before the XXXVI Metropolitan Magistrate, FTC-III, Saidapet, Chennai as imposed in Para No7 in Crl.M.P.No. 1 of 2026 in Crl.A.No.535 of 2026 by an order dated 16.04.2026 on the file of the V Additional City Civil and Sessions Court at Chennai.

O R D E R

This petition has been filed seeking extension of time to furnish sureties before the XXXVI Metropolitan Magistrate, FTC-III, Saidapet, Chennai as imposed in Para No7 of the order dated 16.04.2026 passed in Crl.M.P.No.1 of 2026 in Crl.A.No.535 of 2026 on the file of the V Additional City Civil and Sessions Court at Chennai.

2. The petitioner / accused in a case under Section 138 of the Negotiable Instruments Act was convicted by the trial Court in S.T.C. No. 532 of 2025 by judgment dated 18.03.2026 and was sentenced to undergo six months simple imprisonment and to pay compensation of Rs.20,00,000/- with interest at 6% per annum. Aggrieved by the said judgment, the petitioner preferred an appeal in Crl.A.No.535 of 2026 and also filed Crl. M.P. No. 1 of 2026 seeking suspension of sentence. By order dated 16.04.2026, the Sessions Judge admitted the appeal, suspended the sentence and directed the petitioner to execute a bond for Rs.10,000/- with two sureties for a like sum on or before 30.04.2026 and also to deposit 15% of the compensation amount, i.e., Rs.3,00,000/-.

3. The learned counsel for the petitioner submitted that the petitioner had deposited the sum of Rs.3,00,000/-, being 15% of the compensation amount, on 11.05.2026. Owning to the efforts taken to mobilise the amount for making the said deposit, the petitioner could not arrange sureties and execute the bond within the stipulated time. The petitioner is now ready to furnish sureties. However, the trial Court is not entertaining the same for the reason that it is beyond the time granted by the appellate Court.

4. In view of the above, this Court is inclined to extend the time by two weeks from the date of receipt of a copy of this order to enable the petitioner to execute the bond and furnish sureties before the trial Court.

5. With the above directions, this Criminal Original Petition is disposed of.
