IN THE HIGH COURT OF JUDICATURE AT MADRAS
P.T. Asha, J
Shanmuga Moorthy – Appellant
Versus
Director General Of Police – Respondent
WP No. 19016 of 2026

Advocates:
For the Appellants/Petitioners: G.Bala, Daisy
For the Respondents: AR.Balaji

The court directed the respondent authority to consider and pass orders on the petitioner's representation regarding seniority refixation on merits and in accordance with law within a specified timeframe.

Headnote:The petitioner sought a writ of mandamus under Article 226 of the Constitution of India to direct the respondent to consider a representation dated 18/11/2025 for the refixation of seniority. The petitioner alleged that although selected as a Grade II Police Constable on 01.11.1991, the posting order was delayed until 20.10.1997, and requested seniority revision based on specific judicial precedents including WP.No. 14410 of 2020. The primary issue is whether the respondent is obligated to consider and decide upon a representation for seniority refixation based on existing court judgments. The court observed that the petitioner had made a representation which remained unanswered, necessitating judicial intervention to ensure the administrative process is completed. Accordingly, the writ petition is disposed of.
