Electricity is a basic amenity essential for a dignified life under Article 21; therefore, a service connection cannot be denied to a co-owner solely based on another co-owner's objection, as such connection does not confer ownership or title rights.
Headnote:(A) Electricity Connection - Basic Amenity - Denial of electricity service connection to a co-owner based on objections from another co-owner is impermissible as electricity is an essential requirement for a dignified life. (Para 5)
(B) Right to Life - Article 21 - Deprivation of basic amenities like electricity would be contrary to the spirit and mandate of Article 21 of the Constitution of India. (Para 5)
(C) Property Rights - Nature of Service Connection - Granting an electricity service connection does not confer title, ownership, or possessory rights over the property, leaving such disputes to be adjudicated by a competent civil forum. (Para 6, 9)
Issues: Whether a new electricity service connection can be denied to a co-owner due to the lack of consent from another co-owner.

Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus to call for the records on the file of the 1st respondent in connection with the impugned notice issued by him in Na.Ka.No. USePo/Pa/Bodi/ Va.Aa/Ko./ A.No. 061/2025 dated 04.04.2025 and quash the same as illegal and arbitrary and consequently direct the respondent to provide new Electricity Service connection to petitioner residential house constructed in S.No.1676/4A at Door No.251/I Anaikaraipatty Post, Bodinayakanur Taluk, Theni District by taking account of the petitioner Joint Patta as well as the certificate issued by the VAO within the time limit that may be stipulated by this court.
ORDER
The petitioner challenges the notice dated 04.04.2025 issued by the first respondent. By the said notice, the petitioner was called upon to furnish valid proof and a letter of consent from the second respondent/co-owner for providing a new electricity service connection to the petitioner’s residential house constructed in Survey No.167/4A, situated at Meenavilakku–Meenakshipuram Road, Anaikaraipatti Post.
2.The petitioner had applied for a new electricity service connection to the residential house. At that stage, the second respondent, who is one of the co-owners of the property, submitted objections before the first respondent and requested that an electricity service connection should not be sanctioned in favour of the petitioner. Pursuant thereto, the impugned notice came to be issued calling upon the petitioner to produce valid proof and a consent letter from the second respondent.
3.Heard the learned counsel appearing on either side.
4.Admittedly, the petitioner and the second respondent are co-owners of the property in which the residential house is situated. The revenue records, including the patta produced in the typed set of papers, disclose that the property stands jointly in the names of the petitioner and the second respondent.
5.The petitioner seeks only a new electricity service connection to the residential house. Electricity is a basic amenity and a person cannot be deprived of such amenity merely on account of objections raised by a co-owner. Denial of electricity, which is an essential requirement for a dignified life, would be contrary to the spirit and mandate of Article 21 of the Constitution of India.
6.Further, the grant of an electricity service connection does not confer any title, ownership, possessory right, or any other absolute right over the property in favour of the applicant. The sanction of an electricity service connection is only for the purpose of providing a basic amenity and shall always remain subject to the rights of the parties, if any, to be adjudicated before the competent civil forum.
7.In such circumstances, the insistence on the production of a consent letter from the second respondent is wholly unsustainable.
8.Accordingly, the impugned notice dated 04.04.2025 issued by the first respondent is set aside. The first respondent is directed to process the petitioner’s application and provide a new electricity service connection to the residential house, if the petitioner otherwise satisfies the statutory requirements and formalities prescribed under the relevant regulations, without insisting upon the consent of the second respondent, within a period of four weeks from the date of receipt of a copy of this order.
9.It is made clear that the grant of an electricity service connection shall not confer any special right, title, or interest upon the petitioner in respect of the property and the same shall be subject to the outcome of any proceedings that may be initiated by the parties before the competent forum.
10.The writ petition stands allowed. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
