Versus
THE REGISTRAR OF TRADEMARKS – Respondent
WP(IPD) No.10 of 2026
For the Appellants/Petitioners: Vijayan Subramanian
For the Respondents: S. Janarthanam, SPCGSCS
The court exercised its jurisdiction under Article 226 to issue a direction for the time-bound disposal of a pending administrative application (FORM TM-P) before the Trademarks Registry.
Headnote:The petitioner filed a writ petition under Art. 226 of the Constitution of India seeking a Writ of Mandamus to direct the respondent to dispose of a pending FORM TM-P application dated 17.12.2024 in Application No.5529250. The court noted that the application had been pending since 2024. The primary issue was whether the respondent should be directed to consider and dispose of the pending trademark application within a specific timeframe. The court reasoned that since the application was filed in 2024, a time-bound disposal is necessary. Accordingly, this writ petition stands disposed of.
