Crl.OP(MD) No.13488 of 2026
For the Appellants/Petitioners: P. Karthikeyam
For the Respondents: B. Arun
A docket order returning an application for the return of a vehicle is liable to be set aside if the trial of the underlying NDPS case falls within the jurisdiction of the Judicial Magistrate due to the small quantity of contraband seized.
Headnote:The petitioner filed a petition under Section 528 of BNSS Act seeking to set aside a docket order dated 16.06.2026 passed by the Judicial Magistrate No1, Thoothukudi, which returned an application for the return of a vehicle. The vehicle, owned by the petitioner but used by his brother, was involved in a case initially registered under Section 304(2) of BNS 2023 and subsequently altered under the NDPS Act. The petitioner is not an accused in the case. The primary issue was whether the application for return of vehicle could be entertained by the Judicial Magistrate given that the FIR was registered under the NDPS Act. The court observed that since only 5 grams of ganja were seized, the case would be tried before the Judicial Magistrate, rendering the return of the application unjustified. With the aforesaid observations, this Criminal Original Petition stands allowed.
