COMMON ORDER

A third party to the suit moved the application under Section 47

and Order 21 Rule 97 to Order 21 Rule 104. Pending those applications,

he filed two other applications seeking the relief of appointment of an

Advocate Commissioner and reopening the evidence and to mark certain

documents. Those applications were dismissed. Hence, these revisions.

2.I have heard Mr.S.Srinivasa Ragavan for Mr.M.Thirunavukkarasu,

Mr.Raguvaran Gopalan for Mr.M.Mahaboob Athiff and Mr.Dinesh Hari

Sudarsan, Government Advocate. I have gone through the records.

3.The facts relevant for disposal of these revisions are as follows:

3.1. O.S.No.371 of 1983 is a suit for declaration of title, recovery of

possession and for mesne profits. It was decreed by the Additional District

Court at Srivilliputhur in the last Millennium on 14.07.1993. The

defendants therein preferred an appeal in A.S.No.296 of 1993 to the file of

the Subordinate Court at Srivilliputhur. The appeal suit came to be

dismissed on 17.11.1994. Against the concurrent findings, a second

appeal came to this Court in S.A.No.198 of 1995. The said second appeal

was dismissed on 09.07.2009.

filed in E.P.No.19 of 2010 on the file of the District Munsif Court at
