Prayer : Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the official 1st to 4th Respondents to protect the temple and its properties from the unauthorised activities of the 5th private respondent and consequently restrain the private respondents form interfering with the petitioner hereditary trusteeship, conducting unauthorised Kumbabishekam or other major religious ceremonies, removing soil from the temple lands, or carrying out any renovation, construction, alternation without lawful authority and following the applicable Agama Vidhis, customs and statutory procedures, and considering the representation dated 05.08.2026.

ORDER

The prayer in the Writ Petition is for a Mandamus directing the respondent nos.1 to 4 to protect the temple and its properties from the unauthorised activities including interference with the petitioner’s hereditary trusteeship and stop the unauthorized conduct of Kumbabishekam or other major religious ceremonies, removing soil from the temple lands, or carrying out any renovation, construction, alternation without lawful authority and following the applicable customs.

Upon hearing the learned counsel for the petitioner and perusing the material records, the petitioner claims that Arulmigu Vellai Vaarana Pillaiyar Temple is situated at Kattucherry, Tharangampadi, Mayiladuthurai District which is an ancient temple. It is stated that the temple is traditionally associated with his family and ancestors and he is the hereditary trustee in respect of the temple. Whileso, the 5th respondent is unauthorizedly interfering with the temple properties and its activities and have also now published a notice for conduct of kumbabishekam. Whileso, certain people of the villages claiming themselves to be the trustees and the festival committee are now trying to conduct kumbhabishekam.

If the petitioner claims to be the hereditary trustee of the temple and if the petitioner is not recognised as already, can move the Jurisdictional joint Commissioner under Section 63 of the Hindu Religious and Charitable Endowments (for short ‘HR & CE’) Act to be recognised as the Hereditary Trustee. If the unauthorised persons are conducting kumbabishekam, the petitioner shall forward a complaint to the Jurisdictional Assistant Commissioner, HR & CE Department who will then inspect the temple and find out whether the renovation of the temple has been made in accordance with law and whether the kumbabishekam is being conducted as per law and pass further orders in accordance with his findings thereof. Therefore, keeping open the above liberties of the petitioner to move the appropriate authority under the Tamil Nadu Hindu Religious and Charitable Endowment Act, 1959, the Writ Petition stands disposed of. There shall be no order as to costs.
