JUDGMENT
(Judgment of the Court was delivered by S.M.Subramaniam J.)
The Chennai Port Trust preferred the Intra Court appeal challenging the Writ order dated 28.07.2023, passed in WP No.120 of 2020.
2.The first respondent has instituted a writ petition seeking medical reimbursement claim. Since the Writ Court allowed the claim of the first respondent, the Port Trust preferred the appeal. The first respondent is a retired employee of the Port Trust and retired on 31.05.2015. He is eligible to avail the medical reimbursement claim under the Chennai Port Trust Employees’ (Medical Attendance in the Trust’s Hospital and Reimbursement of Hospital Charges) Regulations 1994.
3.The main contention of the appellants is that the first respondent had not taken any emergency treatment and therefore, he is not eligible. The learned counsel relied on Clause 10 (ii) of the Regulations and would submit that the surgery was conducted, but it was not an emergency surgery. The Chief Medical officer of the Chennai Port Trust certified that there was no emergency circumstances and therefore, the Writ Court granting the relief is running counter to the medical reimbursement policy of the Port Trust. However, it is brought to the notice of this Court that the appellants/Port Trust had already settled the medical reimbursement claim due to the first respondent to the tune of Rs.2,76,605/-. The said amount has been paid as a full and final payment of reimbursement settlement. The said payment was recorded by this Court on 28.03.2024 itself. The first respondent was directed to give an undertaking affidavit which was executed by the first respondent on 22.05.2024.
4.Since the first respondent had already received the medical reimbursement claim of Rs.2,76,605/-, no further adjudication is required and the Writ Appeal stands closed. No costs. Consequently, connected miscellaneous petition is closed.
