ORDER

(Order of the Court was made by S.M.Subramaniam J.)

A Writ of Mandamus has been instituted seeking a direction to the respondents to dispose of the appeal.

2.In a disciplinary proceedings, punishment of stoppage of increment for three years without cumulative effect was imposed on the writ petitioner by the Disciplinary Authority. A statutory appeal has been preferred by the writ petitioner before the first respondent on 26.03.2026. Immediately after filing the statutory appeal, the writ petition has been instituted to dispose of the appeal.

3.Such practice of filing of writ petition at no circumstances be encouraged by the Courts. Several such appeals may be pending before the Registrar General, High Court for disposal. It is brought to the notice of this Court that 133 statutory appeals are pending for disposal. In the event of issuing any directions to dispose of the appeal filed by the writ petitioner, it will affect the rights of the other persons, who had already filed the appeal and waiting for disposal of their appeal. All such appeals are to be decided in the order of seniority and if any priority is required, it is to be decided by the Administration. However, the High Court in exercise of the powers of Judicial Review routinely issuing a direction to the authorities to dispose of the appeal would do no service to the cause of justice. The number of appeals pending and other mitigating factors being faced by the Appellate Authorities also to be considered in such circumstances. Thus, the appeal filed by the writ petitioner is also to be considered in the order of seniority and by following the procedures.

4.With these observations, the writ petition is disposed of. No costs.
