- (ii) Any other relief which this Hon’ble Court may deem just and proper in the facts and circumstances of the case may kindly be issued in favour of the petitioners along with cost of the petition.”
2. It is submitted by counsel for petitioners that respondent No.5 was the owner of Khasra No.161/2 area 3.88 hectares out of which 1.619 hectares of land was sold to petitioners by registered sale deed dated 31.05.2016. A registered agreement was also executed between the parties on 31.05.2016 to the effect that so far as the remaining part of Khasra No.161/2 is concerned, petitioners would develop the property and would take necessary permissions from the Departments and respondent No.5 will bear the expenses of development and expenses for taking necessary permissions. It was further agreed upon that this agreement would be without any consideration amount and respondent No.5 shall remain in possession and owner of remaining part of Khasra No.161/2 and he would be free to alienate the same to anybody. Petitioners after developing the land will not have any share in the profit or in the consideration amount, which may be earned by respondent No.5 after alienating the same.
