ORDER

This petition under Article 226 of Constitution of India has been filed seeking the following reliefs :-

    “7.1 That, this Hon’ble Court may kindly be pleased to issue a writ in the nature of mandamus direction or order to the respondent no.3 to 4, to register a criminal case punishable under section 109/306 of IPC, against the respondent no.5, after conducting investigation in the criminal case of suspicious death of the deceased and further be pleased to file the challan of the criminal case before an appropriate court, in the interest of justice.

7.2 Any other order or direction which is deemed fit under the circumstances of the case may kindly be granted for the interest of justice.”

2. It is submitted by counsel for petitioner that on complaint made by the petitioner, the police has not registered the FIR.

3. It is submitted by counsel for State that the statements have been recorded and the police are of the view that no offence is made out.

4. Be that whatever it may be.

5. A Coordinate Bench of this Court by order dated 29.4.2024 had directed the State Government to seek instructions with regard to the stage of inquiry initiated under section 174 of CrPC in respect of Inquest
