ORDER
This is first application filed by the applicant under Section 438 of code of criminal procedure for grant of anticipatory bail relating to FIR No.312/2023 registered at Police Station-Rampur Naikin, District Sidhi (M.P.) for the offences punishable under Section 8/20 of N.D.P.S. Act.
2. Learned counsel appearing for the applicant submitted that he is Civil Contractor and owner of vehicle bearing registration No. DL2CAK3814. Said vehicle has been sold by him to one Pramod Jaiswal on 25.09.2022. He has also informed RTO Delhi regarding selling of vehicle and for transfer of vehicle in name of purchaser. It is submitted that incident has occurred much after the sell of vehicle i.e. on 08.04.2023. Applicant does not have any role in possessing contraband article Ganja which is said to have been seized by police. Weight of contraband article was 20 Kg. 300 gms. In these circumstances, applicant may be enlarged on anticipatory bail.
