With the consent of the parties, matter is heard finally at motion stage.

Petitioners have filed petition under Article 226 of Constitution of India seeking following reliefs:-

“A. That, an appropriate writ, direction or order in the nature of mandamus or certiorari or as deemed fit be issued to respondent no. 3 to cancel the lease deed executed in favour of Respondent no.5 if executed any after the issuance of the auction sale certificate as the same is in contempt of the Orders of this Hon’ble Court.

B. That an appropriate writ, direction or order in the nature of mandamus, certiorari or as deemed fit be issued to respondent no. 10 to cancel the auction sale certificate of the land in question in favour of Respondent no. 5 and actions undertaken subsequently in pursuance of the auction sale Certificate as the auction sale certificate was itself in direct contravention of the Order dated 15/03/2022 passed by the Hon'ble High Court passed in WP No. 4936/2022. C. That, the respondent no. 4 company be allotted the lease hold rights and be permitted to avail benefit of plotting rights under the relevant amended 'Madhya Pradesh MSME ko Audyogik Bhoomi Tatha Bhavan Aavantan Eva
